Life Sciences, Health and Care

This is a diverse and vibrant sector with innovation at its heart; a sector with which Capital has a natural affinity.

Our Life Sciences, Health and Care team includes experts in intellectual property, commercial law, corporate law, regulatory and compliance, public procurement, employment and dispute resolution – so we’ve got a wide range of specialist knowledge to draw on.

We’re based in Cardiff, and have strong connections with key players in the field, meaning we have direct access to funding options.

Our clients range from exciting start-ups to established organisations in the market such as the British Medical Association (BMA) and PCI Pharma. We are also a provider of legal services to the medical community throughout the UK through BMA Law, an independent law firm established by the BMA.

  • Wales is leading the way for exciting pharmaceutical, biotech, e-health and regenerative medicine businesses in the UK.

The Welsh Government aims to ensure Wales is the best possible environment for Life Sciences innovation and business growth, while Cardiff Bay plays host to the Life Sciences Hub Wales which, together with the Wales Life Sciences Investment Fund, are striking evidence of this ambition.

Our corporate team, with its strong expertise in private equity, is perfectly placed to help businesses balance the need to raise funds while ensuring founders are properly protected.

We often see collaboration in the pharma and biotech sectors, for which properly drafted contracts are crucial. Commercial exploitation and innovation are key, but so is appropriate and effective protection of those involved in drug development. We regularly negotiate and advise on drug development agreements and work closely with a number of specialist patent attorneys to ensure that our client’s commercial interests and intellectual property rights are comprehensively protected. When disputes do arise, our litigation team is on hand to provide fast, industry specific advice.

If you are a Life Sciences business which is not based in Wales and would like to know more about the opportunities available to you in Cardiff, please contact us here.

  • We work with a number of health tech companies that are developing software, applications, procedures and other technological innovations.

Our commercial and IT expertise means we can guide these businesses through the development stages and ultimately maximise their commercial potential, while our administrative and regulatory team ensures pitfalls are avoided.

Many of our clients in this field are start-ups with little more than a fantastic idea and a well of ambition. As the legal partner of the Welsh Government’s Accelerated Growth Programme, which offers individual support to Welsh high growth pre-revenue and SME businesses, we are uniquely placed to help early stage businesses in the health-tech sector in Wales.

As well as providing advice in the UK, we also advise on international transactions in the health sector, particularly those involving international transfers of personal data.

  • We provide a range of legal services to residential care and nursing homes in England and Wales, including buying and selling a care home business, financing a care home, employment law and regulatory matters (in particular CQQC in England and CSSIW in Wales).

We also provide specialist legal advice and assistance to children’s’ day-care nurseries. We can assist you if you are looking to buy or sell a nursery, and have particular experience in the relevant employment law and regulatory issues.

Similarly, we have considerable experience of working with pharmacies, including drafting partnership agreements, assisting in financing the business, employment issues and acting in the sale and purchase of pharmacy businesses.

We regularly advise GPs on existing and new partnership arrangements, as well as assisting in the buying and selling of partnership property.

In addition to our work in the private sector, we also have considerable experience in the public care arena. We are a member of the National Procurement Services in Wales, providing specialist legal services in commercial, procurement and employment law to the public sector.

Much of the work we do in the public sector draws on our extensive construction, property development, finance and commercial expertise. This means that we are ideally placed to advise on large projects, such as the Cylch Caron Project. Here we advised Ceredigion County Council on an £8.1 million collaborative project with the Hywel Dda University Health Board and the Welsh Government to deliver an integrated health care centre, designed to provide health and social care services to the local community.
